USED4SALE Terms of Service

1. Introduction

USED4SALE LLC ("USED4SALE"/"we"/"us"/"our") owns and operates the USED4SALE application available for download via various platforms ("Apps"), collectively referred to as the "USED4SALE Platform".

 

The USED4SALE Platform is a brokerage for registered users ("Members") to buy and sell goods and services to individuals, companies or other registered Agents.

 

Our Terms of Service ("Terms"), privacy policy and user policies including our Prohibited Item List ("Policies") are designed to create a fair, friendly and safe environment for all Members. Adhering to these Terms of use for the USED4SALE Platform assists in preventing any intentional or unintentional breach of our or UAE regulations or laws, thus creating a community of trustworthy users.

 

By registering or using the USED4SALE Platform in any way, Members agree to our Terms and Policies as defined and amended. Such Terms, Conditions and Policies may be updated from time to time at our sole discretion. Members agree to indemnify USED4SALE against any action, legal or otherwise that may be bought as a direct or indirect result of Members failing to adhere to the said Terms, agreements and Policies, USED4SALE is not responsible for any action legal or otherwise bought against Members other than that which is unequivocally proven to be due to negligence on behalf of USED4SALE as directed in a court of law.

 Definitions

"Buyer" means any Member who views, engages or connects with one or more Sellers or Agents with the intent of purchasing Items at any given time.

 

"Item" means any and all good(s) and/or services, products or solutions that have been posted for sale or offer by a Seller via the USED4SALE Platform.

 

"Member Data" means any and all data, including a Member's content or information that Members can retrieve from or provide to via the USED4SALE platform.

 

"Seller" means any Member that posts or makes Item(s) available either for sale or for free via the USED4SALE Platform.

 

“Agent” means a member who uses the USED4SALE platform on a commercial basis, as a primary or secondary business, source of income – primary or otherwise or in a go to market capacity if they are already licensed to do business in the UAE or elsewhere, including freelancers.

 

‘Platform’ the USED4SALE application, network and infrastructure provided as a value-added brokerage for Items to be bought and sold for a fee or otherwise.

 2. What is USED4SALE?

The USED4SALE Platform is a secure online, value - add brokerage marketplace for specialist, high value, used or new items. Located in the UAE, USED4SALE is a unique service that allows buyers and sellers access into many different categories of goods and easy to use in quality assured way.  Members can be buyers, sellers, agents or influencers. Based on a User’s activity USED4SALE may make unsolicited recommendations or suggestions from time to time.

3. Membership and users’ categories

 All Members are required to register; registration is free of charge. You must be over 18 to use the App. If you are under 18, you can use the App providing you have approval from your parent or legal guardian Proof of age along with identification is part of the registration process.

Membership type is defined by your requirements and how you wish to use the platform, Membership starts from basic membership with the option to upgrade to a premium account depending on your activities and transaction values, along with accessing additional features and benefits that we may offer from time to time.

Professional and licensed salesmen and recognized influencers are required to have an “Agent membership” as a minimum and abide to the appropriate set of terms and conditions as defined in this document. Agents can have basic or premium accounts depending on their market and commercial needs.  

It is acceptable for an Agent to hold an existing business license in his own jurisdiction. However, the category of the Agents goods or services on offer listed on USED4SALE must include, as a minimum, the applicable category of user’s independent trade license Freelancers and influencers are welcomed, every member is responsible to abide to his jurisdictional laws & Regulations related to doing business including any federal or local taxation. USED4SALE is not responsible for any Members failure to fulfill any taxation declaration, obligation, or payment in part or full

4. Rules for Buying and Selling

USED4SALE is not responsible for the defined transactions between Members – be it sellers or buyers, USED4SALE is a value-added brokerage platform that facilitates the deals. Additional value-added services that are realized by all users include marketing and advertising, pricing benchmarks where applicable, seller authenticity and secure financial transactions. In addition, USED4SALE provides non-binding tips and advice on safe and secure purchasing and effective selling techniques for further clarity and the avoidance of doubts:

  1. All transactions are made directly between Members on a one to one or one to many basis. The USED4SALE Platform is a brokerage marketplace which facilitates and documents the direct communication between sellers and buyers.
  2. Unless the goods or services offered for sale are labeled on the platform as “verified”, USED4SALE will not pre-screen or examine the goods or services offered by sellers through the USED4SALE application. Sellers must adhere to strict terms and conditions relating to the authenticity, ownership, condition and general status of any goods or services offered for sale however, Buyers are recommended to do their own due diligence to satisfy any queries, in all cases buyers have the right to physically examine, inspect and, subject to seller agreement, try the item (s) purchased and which will be delivered to the addresses against examination fees in order to take a final decision.
  3. USED4SALE allows Sellers to set a fixed or minimum price for the listed item within fair and appropriate margins that can be reviewed from time to time, USED4SALE will review all and any offers and proposals that meet or exceed the price set and send it to the seller anonymously, once offer is accepted by the seller USED4SALE will automatically notify the buyer to pay the accepted price and appropriate fees within 24 hrs. of notification  
  4. Pricing and bargaining:
    Sellers are solely responsible for the fair and accurate pricing their items, and for calculating, remitting, and paying all applicable taxes, fees or charges due in respect of goods or services they sell through the USED4SALE Platform if applicable. Goods or services offered for sale must adhere to the minimum transactional value as set by USED4SALE. The minimal transactional value which EXCLUDES all or any fees is defined in Section 10 as amended
    USED4SALE allows bargaining and negotiation within reasonable margins to be set for each item, we will propose the acceptable bargaining margin and threshold any offers falling outside these margins are not notified to the seller.
    We may review these margins after few days of the listing depending on any feedback, offers or proposals.
  5. Buyers and Sellers must be over the age of 18. Proof of age must be provided at the time of registration (as it may be amended by the UAE federal authority) or have parental or legal guardian supervision or court appointed custodian when buying or selling any Item through the USED4SALE Platform. False or misleading information provided at the time of registration will result in the account being either suspended or cancelled with USED4SALE reserving the right to pursue compensation accordingly.
  6. Sellers must own and/or have the legal right to sell the goods or service(s) posted for sale. Sellers represent and warrant that they are the owners of all or any goods and services they offer for sale on the USED4SALE or have the legal right to dispose them and that the source of these items are lawful and legitimate. USED4SALE will not be held responsible for any goods or services that are misrepresented or sold without proper legal authority or entitlement. USED4SALE will not be held responsible for any breach in copyright or breach of patent.
  7. Valuation services can be provided by authorized representatives of USED4SALE for specific items of value or rarity. USED4SALE may refer the valuation request to approved and verified experts in multiple fields ranging from jewelry, antiques, gems, watches, fashion, furniture, and transportation. All or any such valuations are provided on a good will basis only which may be used for pricing purposes but cannot be deemed as a proposal or offer under any conditions and cannot be subject to liability or claim whatsoever.
  8. Examination: users can request for physical examination of the purchased item to satisfy themselves of the authenticity and condition of goods sold against the original description. The examination is, unless approved by the Seller and USED4SALE, limited to a physical inspection. Any damage to the goods or original packaging caused with or without intent by the Buyer during inspection will render them liable to either purchase or compensate the Seller and USED4SALE accordingly. In this service is requested the good(s) purchased will be delivered to the purchaser registered and approved address for examination. If, after examination, it is found that the goods purchased do not match the description, condition or state defined by the seller on the original advertisement or subsequent communications, the purchaser has the right to cancel the order and get a refund. Examination fees are not refundable. Examination service DOES NOT allow for a change of mind. A refund will only be issued if the goods sold do not match with the advertised condition or state.
  9. Featured listing: USED4SALE offers a variety of premium features. Once the user selects the premium required feature and pays the appropriate fees, the feature is activated. All Sellers requesting a premium feature are obliged to have all goods and services advertised verified by USED4SALE prior to being listed under any premium feature. This verification process will be included in the premium fees.
  10. The USED4SALE Platform is a brokerage service for the posting of Items for sale and subsequent purchase by third parties. USED4SALE does not advertise or sell our own products, goods, solutions, or services through the USED4SALE Platform nor to we actively endorse any of the same. As such USED4SALE, accepts no responsibility or control and, to the extent permitted by prevailing law, makes no representations, warranties, or guarantees in relation to the merchantability, suitability including fit for advertised or deemed purpose, condition, quality, safety or legality of any goods, services or solutions advertised and offered for sale, on payment or otherwise, on USED4SALE. As part of the USED4SALE value-added service we, through best endeavors, ensure a safe, reliable, and secure marketplace through adherence to these Terms, our Policies along with compliance to the Prohibited Items list which all users must adhere to without exception.

 

 

 

5. Prohibited Items

USED4SALE has the right to suspend or delete all and any listing reported or found to be in breach of the Prohibited Items list, USED4SALE reserves the right to remove the item and/or, subject to the severity of the breach, suspend or cancel membership and notify the relevant authorities if the item is in breach of judicial or governing laws

USED4SALE prohibits the sale of items, such as firearms (active, deactivated or replicas), weapons, ammunition, explosives or any part or parts therein, USED4SALE will not permit for sale or advertisement any and all goods or services that are prohibited under Local, National, Regional or Federal law or items requiring special approvals for sale, ownership or use from any legal authority at any time.

Seller’s using the USED4SALE platform must ensure that they are not posting or offering any goods or services that are illegal within the UAE or within the seller’s own jurisdictions. USED4SALE may, at its sole discretion and without notice, remove any item, content, or information that it views as being a Prohibited Item. Members may report any Prohibited Items to USED4SALE for further investigation. 

6. Safety and Security

Safety and Security is the responsibility of all. USED4SALE employs specific technologies and solutions to monitor activities on the platform and identify any potential safety and security concerns. However, all Members have a responsibility and duty to comply with the USED4SALEcSafety and Security Policy 

  1. No bullying, intimidation, or harassment of any kind or nature of any member.
  2. No posting of content that can directly or indirectly defined or interpreted as: hate-speech including Religion, Race, Ethnicity and Personal orientation or is otherwise threatening, is sexual or pornographic in nature; incites or elicits violence; or contains or alludes to nudity or graphic or gratuitous violence.
  3. All Users when interacting with any other members of the community in-person, or through any other medium inside or outside of USED4SALE, shall ensure that no behavior that is in any way: sexual, insulting, threatening, breaks or breeches the laws of the UAE of the User Jurisdiction or violent; intimidates another member of the community or any other person is either initiated or goes unreported. Any form of behavior that is deemed by the relevant laws and regulations or USED4SALE to fall below the expected standard of behavior that you commit to by using the USED4SALE Platform may result in the suspension or cancellation of the perpetrator and the reporting of the same, if necessary, to the relevant authorities
  4. Users agree not to USED4SALE Platform to do anything unlawful, immoral fraudulent, misleading, malicious, or discriminatory.
  5. No posting of unauthorized commercial communications (such as spam) is allowed
  6. No collection, dissemination, sharing or any unauthorized or unpermitted use of Members' content or information other than responding to and facilitating a purchase or sale through the USED4SALE Platform in accordance with USED4SALE terms and conditions.
  7. No access to the USED4SALE Platform using any automated means (such as harvesting bots, robots, spiders, or scrapers).
  8. No unlawful marketing or offers of employment or commission-based activities, such as a pyramid, MLM or Ponzi schemes.
  9. No promoting or linking to other brokerage, commercial sales or other platforms competing directly or indirectly with USED4SALE.
  10. No direct, indirect, subliminal, or psychological marketing or promoting or linking to external websites, physical or virtual shops or venues or mobile applications that contain content that goes against the letter or essence of USED4SALE Terms or Policies, such as but not limited to gambling, prostitution or sexual services of any kind and pornographic websites or web or mobile properties distributing illicit, dangerous, illegal, or copyrighted content.
  11. No public posting of personally identifiable information, such as but not limited to, phone numbers, street addresses or banking information or any information not available freely and easily in the public domain. For your safety, you may only share this information with specific members in private messages.
  12. No uploading of viruses, malware, spyware, tracking or capture software or other malicious code. Whilst USED4SALE maintains technologies to prevent any such activity the User will be responsible for all costs associated with the deliberate or unintentional dissemination of such codes that have a business or service impact on USED4SALE, its users, associates, and authorized systems.
  13. No sharing or direct or indirect solicitation of user information including but not limited to username and password, transactional history or any other information or data that may allow for illicit or illegal activity, fraudulent representation or pecuniary advantage or accessing an account belongs to another registered user.
  14. No goods or services shall be listed or promoted if it violates any applicable law in the UAE specifically the federal commercial agencies law, IP set of laws or items infringing copyright, trademark law, consumer protection law and any other applicable regulations.
  15. No facilitation, encouragement or actual violations of our Terms or Policies shall be permitted
  16. NO attempt to set up multiple accounts for fraudulent or illicit activity

You acknowledge that by using the USED4SALE Platform, you might be exposed to materials that you consider offensive, indecent, or objectionable. By registering an account, you agree not to hold USED4SALE to account for all and any actions that result in use of or access to the USED4SALE platform USED4SALE will not be held liable in any way for such materials or content that are deemed by law or personally offensive, illegal or indecent.

USED4SALE provides a conduit to report such material or content on listed in anyway the USED4SALE Platform (eg. offers for sale or requests to purchase).

USED4SALE reserves the right, but not the legal or moral obligation to regulate content on the USED4SALE Platform. USED4SALE retains the right at its sole discretion to limit, modify, suspend, or discontinue or remove any content and apply any reasonable costs incurred for the same. USED4SALE and its authorized representatives shall not be liable for any losses, damages or harm resulting from such action or inaction.

7. Your Account and undertakings.

For the creation and maintenance of an account along with any additional subscriptions or services offered or provided by USED4SALE, you will be required to provide your real name in full and mobile number, aliases or nicknames are not permitted. Proof of name and any other required information will be requested and were marked as mandatory, must be provided to facilitate the registration and account creation. The User will be solely responsible and liable for any and all loss, damage, and additional costs that USED4SALE, its authorized agents, any user or any other person deemed as applicable, may incur as a result of your submission of any false, misleading, incorrect or incomplete information or your failure to update your registration information as needed in a timely manner.

As such all Users must adhere and agree to the following:

8. Sharing Your Content and Information

Members are the sole and recognized owner the content and information they post on USED4SALE. In addition:

  1. For content that is covered by intellectual property rights, like photos and videos, Members grant USED4SALE a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license right to use, modify, publish, transmit, make available and otherwise exploit content that is posted by Members on the USED4SALE Platform and in any other media for administrative and promotional purposes. By posting content on the USED4SALE Platform, Members represent and warrant that they have the necessary rights to grant the license rights granted herein. USED4SALE will not be held responsible for any actions arising for a breach of copyright or patent.
  2. Members can delete content and information, however if you share information with other Members that information and content may remain available to those Members and the persons with whom they have shared that content and information. It is the sole responsibility of the user to request and ensure any shared information is deleted or not used in anyway against the wishes of the sharing party. USED4SALE will not be held responsible for the misuse or retention of shred information by another user or 3rd party.

9. Privacy

Collection of private information and its retention and processing will be subject to the USED4SALE privacy policy as amended, the UAE federal law No. 45/2021 and its bylaws as amended

By using the USED4SALE Application you agree to the USED4SALE privacy policy and abide to its terms and conditions and give your consent to the collection, processing and usage of the corresponding data which may be used strictly for the safety, security and overall good performance of your transactions and the wider members community interest.

All data collection, retention and processing is transacted in a fair, transparent and lawful manner; personal data collection and retention is restricted to the user transactions; only keeping personal data for as long as required based on the specific purpose and then either deleting or anonymizing it. No financial date other than final price and fees paid is collected or retained on the USED4SALE platform; all financial transactions are completed using an approved and regulated payment platform, operating under financial and judicial UAE laws.

10. Fees & Payments

USED4SALE basic membership is free, downloading the App is free. The application can and must be downloaded from an approved source – in this case being the official application listed on the apple or play store only. USED4SALE will not be responsible under any condition for the application, its content or authenticity if downloaded from any unofficial source.

Listing goods or services for sale are subject to fees depending on the membership category. Goods and services are subject to a minimum value amount depending on the classification of the goods or services offered. Successful transactions are subject to a commission percentage depending on the membership category and transaction type. Physical examination Service upon request is subject to a non-refundable fee.

USED4SALE will only provide and accept payment services through the provided approved and regulated payment platform, operating under the financial and judicial UAE laws only once the payment is received in full, USED4SALE will contact the seller to ship the item to your approved and registered address for delivery or examination.  No part payments or any other type of payment whether offered or agreed will be accepted and payment must be made by the buyer within 24 hours of the seller accepting an offer made. In the event of a failed or refused financial transaction the buyer will be responsible for all and any fees including Seller relisting fees if appropriate.

All and any USED4SALE fees will be deducted from the final and accepted sale price.

If the seller is unable to complete or otherwise cancels the transaction the user is entitled to a full refund with the seller being liable for any fees or reasonable expenses occurred. If the transaction is cancelled after payment is made to seller refund will be made within 3 working days; if the buyer wishes to cancel the transaction after payment is made to seller for any valid reason, then USED4SALE will put both parties in direct contact, based on the term that all and any fees and commissions owed to USED4SALE are nonrefundable.

11. Liability

DISCLAIMER. THE INFORMATION AND MATERIALS PROVIDED ON THE USED4SALE platform ARE PROVIDED on a "AS IS, BEST ENDEVOURS and/or GOODWILL basis." WE DO NOT REPRESENT, WARRANT OR OFFER ANY CONDITIONS THAT Guarantee : (I) THE INFORMATION OR MATERIALS ON THE USED4SALE APP ARE CORRECT, ACCURATE, RELIABLE OR COMPLETE; (II) THE FUNCTIONS CONTAINED ON THE USED4SALE APP WILL BE UNINTERRUPTED OR ERROR-FREE; OR (III) THE USED4SALE PLATFORM OR THE technology platform THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE SPECIFICALLY DISCLAIM ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS, EITHER EXPRESS, IMPLIED, STATUTORY, BY USAGE OF TRADE, COURSE OF DEALING OR OTHERWISE INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, TITLE, SATISFACTORY QUALITY OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT, ENDORSE, GUARANTEE OR ASSUME ANY RESPONSIBILITY FOR ANY Goods OR services ADVERTISED OR OFFERED BY ANY THIRD PARTY THROUGH THE USED4SALE PLATFORM OR IN RESPECT TO ANY WEBSITE or otherwise THAT CAN BE REACHED FROM A LINK ON THE USED4SALE PLATFORM OR FEATURED IN ANY BANNER OR OTHER direct or indirect ADVERTISING ON THE USED4SALE PLATFORM, AND WE SHALL NOT BE A PARTY TO ANY TRANSACTION THAT YOU MAY ENTER INTO WITH ANY SELLER therewith.

LIMITATION OF LIABILITY. UNDER NO CIRCUMSTANCES SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR OTHER DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, ANY DAMAGES THAT RESULT FROM (I) YOUR USE OF OR YOUR INABILITY TO USE, THE USED4SALE APP OR ANY OF THE INFORMATION OR MATERIALS CONTAINED ON ITS WEBSITE, (II) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS, DATA, INFORMATION OR SERVICES, (III) ERRORS, MISTAKES, OR INACCURACIES IN THE MATERIALS ON THE USED4SALE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY prevailing LAW.

You agree that you bear all risk and you agree to release us (and our approved and recognized officers, directors, shareholders, agents, employees, affiliates, subsidiaries, and third party partners) and our designees from claims, demands, and damages (actual and consequential) of every kind and nature, now and in the future, arising out of or in any way connected with your direct or indirect use of the USED4SALE APP.

12. Termination

Members may terminate their account and/or stop using USED4SALE at any time subject to the payment of any outstanding offers, fees or commissions for which USED4SALE reserves the right to pursue accordingly. USED4SALE reserves the right to, at any time, under any circumstances and without prior notice, immediately ban or terminate or suspend or delete all or ANY portion of a member's account or information therein  and/or any access to USED4SALE. Cause for such termination shall include but is not limited to: Violations of these Terms or any other Policies that are referenced herein and/or posted on USED4SALE or imposed by any competent authorities or in force law IN FULL OR PART; A recognized and official request by a registered member to cancel or terminate an account they opened and have the explicit right to close; Discontinuance or material modification to USED4SALE or any party thereof at any time and without notice; A request and/or order from law enforcement, a judicial body, or other official government agency; where provision of the USED4SALE, or any component thereof, to a member is or may become unlawful; unexpected technical or security issues or problems; or participation in fraudulent or illegal activities. Any such termination or suspension shall be made by USED4SALE in its sole discretion, and USED4SALE will not be responsible to any member or any third party for any damages that may result or arise out of such termination or suspension of an account and/or access to USED4SALE.

13. Governing Law & Disputes

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict of laws principles. If anyone brings a claim against USED4SALE related to a Member's actions, content or information on USED4SALE, that Member will indemnify and hold us harmless from and against any and all damages, losses, and expenses of any kind (including reasonable or appointed legal fees and costs) related to such claim. Although we provide rules for member conduct, we do not control or direct Members' actions on USED4SALE and are not responsible for the content or information Members transmit or share on USED4SALE. We are not responsible for any actual, deemed or perceived offensive, inappropriate, obscene, unlawful or otherwise objectionable content or information that may be encounter on USED4SALE.

14. Miscellaneous

Nothing in these Terms and Policies shall prevent us from complying with the prevailing law. We reserve all rights not expressly granted herein. Amendments to these Terms and Policies may be made from time to time without prior notice or justification.

By using the USED4SALE platform, creating an account or in any other way accessing or utilizing the services or information provided therein you are agreeing, without reserve, to the Terms and conditions as stated.
